  Bankruptcy & Insolvency

The Bankruptcy & Insolvency team are here to assist our individual and corporate clients currently struggling with their financial matters.

At BH Solicitors we understand that the recession has had a profound effect on many members of the general public as well as registered companies. As a result of the economic downturn there has been a sharp increase in the number of people and corporations falling into monetary problems.

Having money problems can cause a great deal of stress, and therefore many people instead of dealing with their issues instead choose to bury their heads in the sand and ignore them.

The aim of the Bankruptcy & Insolvency team is to assist our clients in the most severe of these difficult times. Often an arrangement can be made with our clients’ creditors in order to delay or reduce the repayment of debts.

We are specialists in negotiating with creditors, with a number of years of experience in this area, and we are often able to reach a resolution which is favourable for our clients.

We urge our clients to adopt a pragmatic approach to their debt problems. Should you find yourself experiencing difficulties with debt we would encourage you to contact us earlier rather than later, as the earlier action is taken on your matter the more likely it is that we can find a solution for you.

At BH Solicitors we consider bankruptcy to be a last resort to an individual’s personal money problems, although when dealing with a large amount of debt sometimes it is necessary for an individual to decide to take this route upon themselves, we are here to discuss your options and assist you in this situation.

Alternatively, when an individual finds themselves in debt for £750.00 or more a creditor may decide to apply for their bankruptcy.

Should you find yourself in this situation, we shall discuss your current situation with you and whether you are able to defend your position in order to prevent bankruptcy.

Similarly, a company may also find itself in the position whereby it becomes necessary to consider winding itself up if it is unable to meet pay its debts, or a winding up petition being issued against it. As a Director of a company we are here to assist you act in the best interests of the company should it find itself in such a position.
